Please note that if you list or publish any listing on this site a listing agreement will be sent seperatly with the same termsdisplayed on this page that you will need to sign and send back to us. 

If you do not fully agree to these Terms, you are not authorized to access, place a listing or otherwise use the Site. We (“ YachtOwnersDirect.com ”) reserves the right to terminate any Member's use of the Web sites by disabling that Member's access to Yacht Owner Login Areas immediately and without notice if “We” determine that said Owner or Member/s use of the Web sites does not comply with the Terms of Use or Service Agreement. Furthermore, You are also responsible for ensuring that all persons who access our website through your Internet connection and or login details are aware of these terms, and that they comply with them. The “Terms” constitute a legally binding agreement between you and Yacht Owners Direct LTD. You are not authorized to use this Site unless you are able to enter into legally binding contract/s. Further, in some cases, we and a user or member may enter into a separate written agreement or contract providing additional terms and conditions of such user’s use of this Site and incorporating these Terms by reference. No commercial use of this site is permitted. You may use the site for personal, non-commercial purposes only unless a separate written agreement or contract providing additional terms and conditions are agreed and made.

Personal Use

There is no charge or fee to visitors accessing the site and browsing the listings or public pages.  Any visitor to this site is granted unlimited access to public pages, only a member that has registered will be able to access their login areas of the site. Any use of the Site that is not in accordance with these Terms or as otherwise authorized by us in writing is expressly prohibited.

By logging into Yacht Owners Direct for use of the Forum you agree and understand the Forum Rules

• There will be no excessive use of profanity. There will be no racial, ethnic, gender based insults or any other personal discrimination's. Any sexually-oriented, sexist, racist, xenophobic or homophobic, harassing, hateful or even threatening or discourteous in any way.
• There will be no posts meant to offend or hurt any other member, in a manner which is offensive or inflammatory.
• Spamming is not permitted; please keep all your posts as constructive as possible.
• Pornography, Warez, or any other illegal transactions may NOT be linked in any shape or form.
• All posts are property of the poster. This forum and all web sites owned in conjunction with this forum have the right to request alteration or deletion of any offensive post. Posts may be deleted for any reasons the forum administrators deem reasonable.
• Users may not argue a moderators decision publicly. Any and all complaints directed at a moderator must first address the moderator in question via PM. If the problem cannot be resolved, then the moderator and user must send their positions to the forum admin. The forum admin will make or change any and/or all final decisions.
• Advertising, commercial-related or competing products are all forbidden in any relation to your account. “The Forum” is not to be used as a vehicle for business promotion. • Please keep foul language off the forums, any excessive or un-called for language will be removed and you will receive a final warning.
• Remember to post in the correct forum. Take your time to look at other topics and see where your topic should go. If your topic is placed in the wrong forum, it will be moved by a moderator.
• If a topic is recognized as being posted in the wrong forum, or if the post is a violation of our guidelines then please contact a moderator either via PM or the 'report post to moderator' feature; please do not respond publicly to the member - a member of staff will do what is required upon contact. Any person/s who attempt to present themselves as a Moderator by posting negatively to a member's topic (which has been posted in error and requires locking or moving to another forum) will be sent a PM warning and placed into moderation queue upon further actions.
• Any impersonation of a user from these forums, in any mode of communication, is strictly prohibited and will result in a immediate banning.

No member may submit or upload any inappropriate, violent, racial or sexual material to our Site or into our database, misuses the Site or our online system or is in material breach of these Terms, we reserve the right to remove immediately such member’s listings from the Site without refund. We urge all users to be responsible about their use of this Site. Yacht Owners, Central Agents, Managers, Members, Service providers and crew retain ownership of the original text including photos and other works they provide to YachtOwnersDirect.com, however once the Materials are posted on the Web sites, they become part of the Web site and the Content and can be used by Yacht Owners Direct LTD. We reserve the right to refuse to publish any content that we determine, in our sole discretion, does not meet these Terms or is otherwise unacceptable to us and does not meet with our Content Guidelines. The Site and all content on the Site are protected by copyright as a collective work and/or compilation, pursuant to international copyright laws and conventions and database rights. You agree to abide by any and all copyright notices, information, or restrictions contained in or relating to any content on the Site. We reserve the right to refuse any hypertext or links to, or addresses of other web sites from members' pages. Furthermore we also reserve the right to remove links or web addresses without notice at our sole discretion and if they do not meet our Content Guidelines . Terms and Limitations of Communications and Use of Other Users’ Information.

You agree that, with respect to other users personal information posted on the site that you obtain through the Site or through any Site-related communication we have allowed a license to use such information only for Site-related communications that are not unsolicited commercial messages. Listings & Legal Requirements

Each entry must relate to an individual and uniquely identified yacht, service or crew profile listing. In your control panel you will have the ability to see each of your listings as unique entries and be able to modify or amend them. By listing a boat or yacht on “this site”, you agree that each boat/yacht that you have listed on this website is registered and certified as a commercial or charter vassal. We “Yacht Owners Direct.com” are not responsible to insure that you comply with your local regulation and you agree to notify us as soon as possible if there are any changes to your vessel/s statues so we can remove your listing.

Yacht Charter or purchase.

It is your responsibility as a user of this site to insure that a legal binding contract is signed when you contact any owner, operator or central agent though our site when booking a charter or making a purchase. We "Yacht Owner Direct Ltd" are purely used as a medium to make contact with a listing.

Boat & Yacht Charter Listing Criteria & Conditions

In order to be listed on the Yachtownersdirect.com site you need to have the following criteria:

• Any vessel/boat/yacht (any charter listing) has to have Full Charter licensing for all of the waters where we promote your boat.
• Appropriate Skipper Certification (on Crewed Yachts).
• Charter Yacht Insurance.
• A boat that is in excellent repair and condition.
• A commitment to customer satisfaction.

You agree that the information listed on the site is the best and most accurate information to your knowledge. You agree that you are responsible for compliance with any and all laws, rules and regulations in your local country that may apply to any yacht or boat you list on the Site for sale or for charter and we assume no responsibility for your compliance. Furthermore you agree that if you are not the yacht owner or Central Agent that you have full consent from the owner to list the boat on this site and proof of consent must be sent to us in writing or by email if we require or request this information. Please be aware that, even though we are not a party to any transaction and assume no liability for legal compliance pertaining to yacht/s or boat/s listed on the Site, there may be circumstances where we are nevertheless legally obligated to provide information relating to your listing in order to comply with governmental bodies in relation to investigations, litigation or administrative proceedings, and we may choose to comply with or disregard such obligation in our sole discretion.

Operator Responsibilities

The operator agrees to handle all communication, contacts and payments with the client. Further, the operator commits to strive in all ways possible for customer satisfaction. This includes full repair and cleanliness of the boat, departing on time, attempting wherever possible/reasonable to meet customer requests and needs.

Boat & Yacht sale & Brokerage Listing Criteria & Conditions

Crew Listings

You agree that the information you list on this site is the best and most accurate information to your knowledge. We assume no responsibility for your compliance. Please be aware that, even though we are not a party to any employment or contractual ventures you may encounter from your listing and assume no liability for legal compliance pertaining to your listing on the Site, there may be circumstances where we are nevertheless legally obligated (as we may determine in our sole discretion) to provide information relating to your listing in order to comply with governmental bodies in relation investigations, litigation or administrative proceedings, and we may choose to comply with or disregard such obligation in our sole discretion. Crew agents must contact us before listing any crew profiles on this site on behalf of a crew member.

Our Right to Terminate a Listing

If any member submits inappropriate, violent, racial or sexual material to our Site or into our database, misuses the Site or our online system or is in material breach of these Terms, we reserve the right to remove immediately such member’s listings from the Site without refund. In addition, if we become aware of or receive a complaint or a series of complaints from any user or other third party regarding a member’s listing hold the right to remove immediately such member’s listing from the Site (for example, and without limitation, if a member double-books a charter for multiple groups on the same date, or engages in any practice that, in our sole discretion, would be considered unfair or improper within the charter industry, or if we receive a complaint that any listing’s content infringes on the rights of a third party), then we may immediately remove the listing from the Site without notice to the member and without refund while we investigate the basis for the complaint. If we conclude, in our sole discretion, that any such complaint is meritorious, then we may permanently remove the offensive listing from the Site without notice to the member and without refund. If any member is in breach of these Terms or its obligations to us then we may immediately remove such member’s listing from the Site without notice to the member and without refund.

Methods of Payment

Payment for listings

We (YachtOwnersDirect.com) have secure online payment for all major credit cards through "The Mauritius Commercial Bank Limited" or MCB. When you make payment on our site you will be directed by an SSL feed to "The Mauritius Commercial Bank Limited" site to make secure online payment, we do not store or hold any information when making payment. Bank transfers are also accepted for more than one listing, at the final stage of your listing you will be prompted to pay by card or bank transfer  please contact us for more information.

Payments between members, Service Providers and charterers: We are not a party to any payment transaction between members and users of this site, nor do we assume responsibility for compliance. Please be aware that, even though we are not a party to any transaction and assume no liability for legal compliance pertaining to any transactions. No member may request any user to mail cash, or utilize any instant-cash wire transfer service such as Western Union in payment for all or part of a transaction. Any violation of this term or any other unacceptable payment methods that may be posted on the Site may result in the immediate removal of the listing from the Site without notice to the member and without refund. From time to time, we may become aware of users attempting to conduct a transaction that would involve an unauthorized payment method or a fraudulent payment method. Ideally, we hope to be able to assist users in avoiding such transactions, but we assume no liability or responsibility to do so or to inform users of any such actual or suspected activity. There may be circumstances where we are nevertheless legally obligated (as we may determine in our sole discretion) to provide information relating to your listing in order to comply with governmental bodies in relation investigations, litigation or administrative proceedings.

Unauthorized Uses of the Site.

Terms of use for this site does not include any right of collection, aggregation, copying, scraping, duplication, display or derivative use of the Site nor any right of use of data mining, robots, spiders or similar data gathering and extraction tools without our prior written permission. You may not reproduce any portion of the Site on your website or otherwise, using any device including, but not limited to, use of a frame or border environment around the Site, or other framing technique to enclose any portion or aspect of the Site, or mirror or replicate any portion of the Site; Modify, translate into any language or computer language, or create derivative works from, any content or any part of the Site; Reverse engineer any part of the Site; Sell, offer for sale, transfer, or license any portion of the Site in any form to any third parties; Use any robot, spider, scraper, other automatic device, or manual process to monitor, copy, or keep a database copy of the content or any portion of the Site.
